What is Trademark Objections and Examination Reports in the Indian Trademark Registry?
When applying for a trademark in India, your application goes through a process monitored by the Trademark Registry. The two most important steps in this process are the trademark objection and the responding to the Examination Report.
1.Trademark Objections
After filing your trademark application, the Trademark Registry thoroughly examines it to ensure it complies with all legal requirements. If you find any information, you will be sent you an examination report showing Objection-Marked for Examination. This information will explain why they are concerned about your application. The most common scenario is if your trademark is too similar to an existing one, is not unique, or violates any laws.
What to do: If you receive a receipt, don’t worry. You will have an opportunity to respond in approximately 30 days. Together, we will address the concerns raised in the examination report. We will gather evidence and argue to show why your trademark should be approved.
2.Examination Report
This report summarizes the findings of the examination of your application for trademark registration. This includes information about whether your trademark has been approved or if there is any objection. If you do not have a trademark objection, the report may indicate that it is ready for publication in the Trademark Journal. However, if objections are raised, they will be documented in the report with instructions for response.
What to do: If objected, we will meet and review the report thoroughly. We then prepare a response to address concerns raised by subscribers. Our goal is to ensure that your trademark application meets all requirements and moves forward smoothly.
